by 是表示方式，这里不选择because of也是因为because of 本来就不符合这句话的本意。本意是，银行通过falling to honer。。。而参与商业欺骗活动，而不是“因为”falling to honer。。。而参与了商业欺骗活动~~
为什么不能理解成 state's attorney accuse bank because of its failure呢？ 这个because of 为什么不能用来修饰attorney？
楼上 leesanity 解释的很清楚。就是考官要考的意思的就是这个（因为原来 A 用的就是 Byblahblahblah，这就是考官觉得说的同的句意）。

1-根据句意指的是通过一种方式，只能在AB里面选；
2-考察名词和动名词的区别：名词强调事件的结果，动名词强调事件的过程；句意是说 银行有欺诈行为是通过失信于承诺，这个更多偏向与过程而不是结果，因此用动名词，选A
看到题目的时候我想fail这里是外延内涵。当时我认为是fail这个行为必然有一个终点的，不然不会被起诉，所以我选择B。
在看到答案的时候我只能通过说 律师起诉的是一个行为，这个行为一直存在，所以说是没有终点的-ing或者that。
我不确定这样是否正确，请指正
虽然我也做错...选B，但是仔细想想failure of/in sth.好像sth都是名词或者名词短语啊，没见过failure of doing sth...的，接谓语的都是fail to do sth.
此外by后面是不是一般都是doing sth....也没有见过by sth.(一个名词)，除了by sea, by air 之外的
唉。。但是这个用固定搭配来选择。。。其实心里不是特别有底……
哈哈哈哈哈 希望有大佬提出更好的解题思路
也许是fail的约束力强，宾语跟to do；its重复的也很频繁
这道题目我还是想不通。。是否因为是by+doing是指通过一个手段？

D为什么不对呀
首先，感觉D项的表达很wordy；其次，感觉句意是想说银行通过falling to honer...而参与了商业欺骗活动，而不是“因为'falling to honer...'而参与了商业欺骗活动“。轻拍~~

the state's attorney general accused the bank of engaging in deceptive business practices by failing to honor its promise to its customers to keep records private。by failing是状语从句，修饰动词engaging，所以其主语也是bank不是the state's attorney general（虽然bank并没有构成一个句子），这里failing没有歧义？
老师 这里面的keeping和to keep 用到了外延和内涵的考点吗 是有关约束力强弱的方面吗
当然。promise肯定是约束力比较强的嘛~
